Dispute Resolution
Our approach to dispute resolution is strategic, evidence-driven, and outcome-focused, balancing strong advocacy with practical resolution pathways that protect our clients’ commercial and institutional interests.
Pre-Dispute Strategy, Negotiation & Risk Assessment
The Firm advises clients at the earliest stages of potential disputes, including risk identification, contractual analysis, and dispute avoidance mechanisms. We assist clients in structured negotiations and without prejudice engagements, with the objective of resolving disputes before they crystallize into formal proceedings. Where appropriate, we advise on escalation clauses, dispute avoidance boards, and contractual preconditions to formal dispute resolution.
Mediation & Conciliation
Where disputes are suitable for consensual resolution, NS-KIGOZI Advocates represents clients in mediation and conciliation proceedings, facilitating structured dialogue aimed at preserving commercial relationships and achieving timely settlement in accordance with the parties’ autonomy and applicable law, whether national or international. The Firm’s advisory spans mediation strategy, preparation of position papers, and settlement documentation, ensuring that any agreed outcomes are legally enforceable and commercially sound.
Adjudication & Dispute Boards
In construction and infrastructure matters, the Firm represents clients in adjudication and dispute board proceedings, which provide fast, interim binding decisions aimed at maintaining project cash flow and continuity. We advise on jurisdictional issues, procedural compliance, timely claims preparation, and enforcement of adjudicators’ decisions, while positioning clients strategically for any subsequent arbitration or litigation where disputes remain unresolved.
Arbitration
NS-KIGOZI Advocates acts as counsel in domestic and international arbitration, representing clients under the Arbitration and Conciliation Act, Cap. 5 (as amended), and under leading institutional and ad hoc rules, including ICC, LCIA, DIAC, SIAC, and UNCITRAL. The Firm advises on the full arbitration process, including commencement, interim measures, evidentiary strategy, hearings, and post-award enforcement in construction, infrastructure, and complex commercial disputes.
Litigation & Enforcement
The firm ably represents clients in de novo commercial and civil litigation, as well as in court proceedings arising from arbitration, adjudication, and other alternative dispute resolution processes. We advise on procedural strategy, interim relief, appeals, and execution, ensuring that litigation is pursued strategically and as a last resort, aligned with clients’ commercial objectives with a focus on procedural efficiency and outcome-driven strategy. Where appropriate, the Firm pursues or defends applications for interim relief, injunctions, and preservation orders.
In addition, NS-KIGOZI Advocates advises on the recognition, enforcement, or challenge of arbitral awards and adjudication decisions, as well as appeals and execution proceedings. Litigation is approached as a strategic tool, deployed where necessary to protect clients’ rights and interests, and not merely as a default escalation.
